Chicken farm planning changes deferred

An application by a powys county councillor to remove a condition that curbs the times of pick ups and deliveries to a chicken farm near Llanfair Caereinion has been deferred.
This was because the application dealt with only half the chicken farm.
At the planning committee meeting councillors discussed applications made by fellow councillor Gareth Jones, an independent representing Llanfair Caereinion.
In August 2019 he was given permission to double the size of his chicken farm at Rhiw Hiraeth Isaf, near Llanfair Caereinion, from 16,000 to 32,000 birds.
The application sought to delete condition 10 which is:
“All deliveries to and from site in connection to this application shall be carried out between the following hours, Monday to Friday from 8am to 6pm, Saturdays from 8pm to 1pm hours and at no time on Sundays, bank and public holidays.”
He had argued that his farm is far enough from neighbour not to need it.
But, last minute updates to the planning officers report revealed there had been an objection on the grounds of noise disturbance.
Planning officer, Rhys Evans, said: “Given the distance to the properties it is not considered that removing the condition would cause an adverse impact.
“In the original application, environmental health were consulted and did not request that condition.
“It is therefore considered that it’s unnecessary in this instance.”
Councillor Hywel Lewis said: “Just for clarification, this condition was not attached to the first building?
“Am I correct in understanding that?”
Mr Evans answered that the condition was attached to the first poultry unit, but this application was to take the condition off the new building.
Cllr Lewis added: “It’s a ridiculous situation taking it off one and not the other.”
“It’s either both or neither, that’s the way I see it.”
With other councillors pointing out the lack of logic with the application, the meeting was adjourned to allow officers to look back on the conditions put on the first planning approval back in 2017.
During this break, planning development manager, Peter Morris received a phone call from a planning agent about this application
Mr Morris told councillors: “He’s advised me there is a condition on the first building, controlling the delivery times.
“They made the application just for the second building, he would be willing to defer that, to come back and look at both together.”
Councillor Roger Williams, said: “If this wasn’t a county councillor’s application it would never have come before the committee.
“And it has raised a lot of issues.”
Cllr Williams believed that too many conditions put on planning approvals were being dropped using the non-material amendment process.
The deferral was agreed unanimously by councillors, and the application will return to the committee at a future date.
