Recycling site conditions likely to be removed

Planning officers are recommending four conditions currently imposed on the planning permission for a bulk recycling centre and business park at Abermule are removed.

The removal of the conditions has proved contentious as they cover land drainage on the site and also allow work to be undertaken without a site investigation into contamination.

It has emerged that asbestos had been found on the site.

The council's planning committee will consider the applications to have the conditions removed from the planning permission on Thursday.

The council wants to remove conditions 8 and 12. These state:

"No development shall take place until a site investigation of the nature and extent of contamination has been carried out, by a suitably qualified competent person, in accordance with a methodology which has previously been submitted to and approved in writing by the local planning authority.

"A written report of the findings of the site investigation shall be made available to the local planning authority before any development begins.

"The written report should include an appraisal of remedial options and identification of the most appropriate remediation option(s) for each relevant pollutant linkage. The report is subject to the written approval of the local planning authority."

Abermule Community Council has objected to the conditions being removed. It said: "The Contamination report should have been presented and approved prior to the application to discharge items being considered. This application has been undertaken in the incorrect order. By doing this could endanger the health to residents and works on site."

Another condition the county council wants removed is confirming details of the colour of the recycling facility. Condition 19 states:

"Notwithstanding the approved plans, prior to the commencement of development
details of the external colour of the recycling bulking facility shall be submitted to and approved in writing by the Local Planning Authority. Development shall be carried out in accordance with the approved details."

The community council objected to this condition being removed. It said: "With regards to condition 19 The Community Council has not been consulted or involved in discussion as previously stipulated.

"The montage displayed totally misrepresents reality in respect of proportion of the building and its surroundings."

The council officer has recommended the conditions are discharged.
